A law that will promote the development of viticulture and horticulture comes into force

On January 4, the President of Ukraine signed the Law “On Amendments to Certain Legislative Acts of Ukraine on Stimulating the Development of Viticulture and Horticulture” No. 1989-IX, adopted by the Verkhovna Rada of Ukraine on December 17, 2021.

In particular, the law expands the list of citizens of Ukraine who have the right to purchase land plots of state and communal property for peasant (farming) farming. Thus, the purchase of state and communal land by citizens who acquired the right to lease land by re-registration of the right of permanent use for the specified land plots is envisaged until 2016, and not until 2010, as was the case before.

Also, starting in 2024, citizens will have the right to purchase land with land belonging to perennial plantations, if such persons have been growing perennial plantations (fruit, berry, nut-bearing plants, grapes) on the specified plots of land for at least three years.

In addition, the law makes changes to the Land Code of Ukraine and the Law of Ukraine “On Land Lease” regarding the establishment of a minimum term of 25 years for the use of land plots under vineyards or for their establishment.

Also, issues of reimbursement to the user of his costs incurred for planting (planting) and/or tending vineyards, as well as damages incurred in case of premature termination of the right to use the land plot are regulated.
