On November 25, the Cabinet of Ministers of Ukraine approved the Procedure for the reconciliation of the information of the State Register of Property Rights to immovable property regarding land plots, the property rights and their encumbrances on which are registered, with the information of the State Land Cadastre regarding the existence of state registration of such land plots. The procedure was developed in order to protect the rights of the owners of land plots and to avoid possible raider seizures. This was reported by the First Deputy Minister of Justice Yevhenii Horovets.
According to him, the changes made by the Law of Ukraine of December 5, 2019 No. 340-IX “On Amendments to Certain Legislative Acts of Ukraine on Countering Raiding” in the areas of land relations and state registration provide effective mechanisms for the interaction of the information systems of the State Register of Rights and the State Land Registry, which allow state registrars to receive real-time information from the State Land Registry about rights to land plots registered to 2013, and to the bodies that maintain the State Land Cadastre – according to information from the State Register of Rights about registered property rights to land plots, their encumbrances.
Yes, the approved Procedure defines the procedure for organizing and carrying out by the Ministry of Justice and the State Geocadastre a one-time reconciliation of the information of the State Register of Rights regarding land plots, property rights and their encumbrances on which are registered, with the information of the State Land Cadastre regarding the existence of state registration of such land plots, as well as the publication on the official website of the Ministry of Justice of the results of such a reconciliation in the part of land plots for which no information was found about their state registration in the State Land Cadastre.
“Comparing the information of the State Register of Real Property Rights and the State Land Cadastre is an additional mechanism for protecting the rights of land owners against possible raiding. In addition, this mechanism will eliminate the possibility of a mistake by the state registrar during the state registration of property rights to land plots,” Yevhenii Horovets added.
