On September 9, at a meeting of the Cabinet of Ministers of Ukraine, a resolution was adopted that amends the Methodology for determining the amount of damage caused as a result of arbitrary occupation of land plots, use of land plots not for their intended purpose, removal of soil cover (fertile soil layer) without special permission.
“Today, some agricultural producers violate the order of land use – cultivation of pastures, arbitrary seizure of state lands, because the current calculation of losses caused to the state does not exceed profits from land use. In addition, local budgets do not receive funds from land fees. The government is introducing an effective mechanism to deal with violators of land legislation, increasing the calculation of damages by approximately three times. This will make the violation of land legislation economically unprofitable,” commented Deputy Minister of Economic Development, Trade and Agriculture of Ukraine Taras Vysotskyi.
The decree provides:
– to increase the amounts of the average annual income from the use of land for the intended purpose;
– the average annual additional income received as a result of the actual use of land plots not for their intended purpose;
– normative losses from the destruction of the soil cover (fertile soil layer) without special permission, which are used in calculating the amount of damage caused by the arbitrary occupation of land plots, the use of land plots not for their intended purpose, the removal of soil cover (fertile soil layer) without a special permission;
– making changes to the Methodology in part: the procedure for applying the indexation coefficient of the normative monetary valuation of land, which is used in calculating the amount of damage caused as a result of the arbitrary occupation of land plots, the use of land plots not for their intended purpose, the removal of soil cover (fertile soil layer) without special permission.
