Citizens of Ukraine – owners of State acts on the right to private ownership of land, including those issued before 2004, not entered into the automated system of the State Land Cadastre and in the absence of a cadastral number, it is necessary to perform a complex of works to enter information about the land plot into the State Land Cadastre.
The cadastral number is mandatory when concluding agreements on the transfer of ownership of land plots (inheritance, purchase and sale, etc.), pledge of land plots or rights to them (Articles 132, 133 of the Land Code of Ukraine).
The normative monetary valuation of a land plot within a settlement without a cadastral number is three times higher than that of land plots assigned a cadastral number, which increases the amount of land tax (Order of the Ministry of Agrarian Policy of 25.11.2016 No. 489 and Article 201 of the Land Code of Ukraine), and for agricultural lands outside settlements, it is generally impossible (Order of the Ministry of Agrarian Policy dated 23.05.2017 No. 262).
In order to enter information about a land plot in the cadastre and assign a cadastral number, the owner must take three steps:
• Order technical land management documentation regarding the establishment (restoration) of land plot boundaries in kind (on site) from the developer of land management documentation at any land management organization;
• Submit the developed documentation to the Center for the provision of administrative services for the State registration of the land plot;
• Get an extract from the State Land Cadastre about assigning a cadastral number to a land plot and entering information into the State Land Cadastre free of charge;
• Register the right to a land plot in the State Register of Property Rights in the Center for the Provision of Administrative Services.
Entering information about a land plot in the State Land Cadastre is a guarantee of free disposal of the land plot.
