On November 4, the Verkhovna Rada of Ukraine adopted in the second reading the draft law “On Amendments to Certain Legislative Acts of Ukraine on Specifying the Procedure for Leasing Water Objects in a Complex with Land Plots.” 

The main innovations of the bill are:

• improvement of the procedure for the lease of water bodies in a complex with land plots;

• the obligation of tenants of the water object to provide other water users with the opportunity to carry out special water use;

• obligations of the lessee regarding the implementation of measures to protect and improve the ecological condition of the water body, the operation of reservoirs and ponds in accordance with the established operating modes;

• obligations of the lessee regarding the need to register the right to use hydrotechnical structures and the right to special water use;

• establishment of a five-day period after the state registration of the right to lease a land plot of state or communal property for providing a copy of the lease agreement to the relevant tax authority, and in the case of leasing a land plot in a complex with a water object located on it – also to the relevant territorial body of the central executive body implementing state policy in the field of water development economy.
