font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">No. 161-XIV <\/span><\/a><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">of 6 October 1998.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Article 31 of Law <\/span><a style=\"text-decoration: none;\" href=\"https:\/\/ips.ligazakon.net\/document\/T980161?utm_source=buh.ligazakon.net&amp;utm_medium=news&amp;utm_content=cons13\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">No. 161-XIV<\/span><\/a><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\"> provides for one of the grounds for terminating a land lease agreement: the expiry of the term for which it was concluded.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">If such a contract contains a clause regarding its renewal upon expiry of the term for which it was concluded, the provisions of Article 1261 of <\/span><a style=\"text-decoration: none;\" href=\"https:\/\/ips.ligazakon.net\/document\/T012768?utm_source=buh.ligazakon.net&amp;utm_medium=news&amp;utm_content=cons13\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">the Land Code<\/span><\/a><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\"> of Ukraine should apply.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Thus, in accordance with the requirements of Parts 2\u20134 of the aforementioned article, a contract containing a clause regarding its renewal upon expiry of the term for which it was concluded shall be renewed for the same term and on the same terms.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">A party to the agreement who does not wish to renew the agreement must submit an application to the State Register of Rights to remove information regarding the renewal of the agreement from that register. This must be done no later than one month before the expiry of such an agreement.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Thus, the holder of a certificate for a land share (parcel) who does not wish to renew the land lease agreement for a new term must:<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">&#8211; if the agreement contains a clause regarding its renewal upon expiry of the term for which it was concluded \u2013 no later than one month before the expiry date of such agreement, submit to the state registrar or notary a request to remove information regarding the renewal of the agreement from the State Register of Rights;<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">&#8211; if there is no such clause \u2013 upon expiry of the agreement and if the tenant has not notified of their intention to exercise the pre-emptive right to conclude a land lease agreement for a new term (where such a right exists), conclude a lease agreement with another tenant.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span id=\"docs-internal-guid-de7c3620-7fff-efea-88b4-352d19198b37\">\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.7999999999999998; text-indent: 28.35pt; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 11pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Source:  www.buh.ligazakon.net<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>According to the website of the Ministry of Justice of Ukraine, the termination of a land lease agreement is permissible only in the cases specified in the Law of Ukraine \u2018On Land Lease\u2019 No. 161-XIV of 6 October 1998.
