margin-bottom: .0001pt; line-height: 150%; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; line-height: 150%; font-family: 'Arial',sans-serif; color: black;\">The Main Directorate of the State Tax Service in the Odesa Region hereby informs that, pursuant to paragraph 288.1 of Article 288 of the Tax Code of Ukraine (as amended; hereinafter \u2013 the TCU), the basis for calculating rent for a land plot is the lease agreement for that land plot.<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">In accordance with Article 2 of the Law of Ukraine No. 161-XIV of 6 October 1998 \u2018On Land Lease\u2019 (as amended, hereinafter \u2013 Law No. 161), relations relating to land lease are governed by the Land Code of Ukraine, the Civil Code of Ukraine, Law No. 161, the laws of Ukraine, other regulatory acts adopted in accordance therewith, and the land lease agreement.<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">Payers of rent are land users (tenants) of state- and municipally-owned land plots under lease terms (sub-clause 269.1.2 of clause 269.1 of Article 269 of the Tax Code of Ukraine).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">The amount and terms of payment of rent are established in the lease agreement between the lessor (owner) and the lessee (except in cases where such land plots are subject to conservation or are recognised as contaminated (potentially contaminated) with explosive objects) (clause 288.4 of Article 288 of the Tax Code of Ukraine).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">The subject matter of a land lease agreement is deemed to have been transferred by the lessor to the lessee from the moment of state registration of the leasehold right, unless otherwise provided by law (Article 17 of Law No. 161).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">A land lease agreement is terminated, in particular, upon expiry of the term for which it was concluded (Article 31 of Law No. 161).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">Pursuant to Article 33 of Law No. 161, upon expiry of the term for which the land lease agreement was concluded, a lessee who has duly performed their obligations under the terms of the agreement shall have a pre-emptive right over other persons to conclude a land lease agreement for a new term.<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">A tenant intending to exercise the preferential right to enter into a land lease agreement for a new term must notify the lessor of this before the expiry of the land lease agreement within the time limit established by that agreement, but no later than one month before the expiry of the land lease agreement.<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">The right to lease a land plot arises from the moment of state registration of such a right (Article 19 of Law No. 161, Article 125 of the Land Code of Ukraine (as amended, hereinafter \u2013 the LCU)).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">Official recognition and confirmation by the state of changes to rights in rem over immovable property is ensured by entering the relevant details into the State Register of Rights in Rem over Immovable Property on the basis of a submitted application and documents for the state registration of such changes (paragraph 1 of part one of Article 2 of the Law of Ukraine \u201cOn State Registration of Real Rights to Immovable Property and Their Encumbrances\u201d (as amended)).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">If the contract contains a clause regarding its renewal upon expiry of the term for which it was concluded, the contract shall be renewed for the same term and on the same terms. Renewal of the contract is deemed to be the renewal of the contract without the parties to the contract entering into a written legal act regarding its renewal in the absence of a request by one of the parties to remove information regarding the renewal of the contract from the State Register of Real Rights to Immovable Property. No other actions by the parties to the contract are required for its renewal (part two of Article 126, note 1 of the Land Code of Ukraine).<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">In view of the above, if a business entity continues to use the land plot after the expiry of the lease agreement and has not received a written objection from the local authority (the lessor) regarding the use of the land plot, then until a new lease agreement is concluded, such a business entity must pay rent in accordance with the terms of the previous land lease agreement.<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; text-indent: 34.0pt; background: white; vertical-align: baseline;\"><span lang=\"UK\" style=\"font-size: 10.5pt; font-family: 'Arial',sans-serif; color: black;\">In this case, the annual rent may not be less than the amount specified in sub-clause 288.5.1 of clause 288.5 of Article 288 of the Tax Code of Ukraine.<\/span><\/p>\n<p class=\"MsoNormal\"><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"UK\" style=\"font-size: 10.5pt; line-height: 107%; font-family: 'Arial',sans-serif;\">\u00a0<\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span lang=\"UK\" style=\"font-size: 10.5pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Source<\/span><span style=\"font-size: 10.5pt; line-height: 107%; font-family: 'Arial',sans-serif; mso-ansi-language: RU;\">:<\/span><span lang=\"UK\" style=\"font-size: 10.5pt; line-height: 107%; font-family: 'Arial',sans-serif;\"> Main Directorate of the State Tax Service in the Odesa Region<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Main Directorate of the State Tax Service in the Odesa Region hereby informs that, pursuant to paragraph 288.1 of Article 288 of the Tax Code of Ukraine (as amended; hereinafter \u2013 the TCU), the basis for calculating rent for a land plot is the lease agreement for that land plot.
