In a letter dated June 4, 2021, signed by the first deputy head of the department, the State Geocadastre of Ukraine explains the procedure for simplifying the resolution of boundary disputes.<\/p>\n<\/p>\n
On May 27, 2021, the Law of Ukraine dated April 28, 2021 No. 1423-IX “On Amendments to Certain Legislative Acts of Ukraine Regarding the Improvement of the System of Management and Deregulation in the Field of Land Relations” (hereinafter – Law No. 1423) entered into force, which provides, in particular, the introduction of a number of amendments to the Law of Ukraine “On Land Management”, which provide for the inclusion of various types of land management documentation instead of the “deed of acceptance and transfer of boundary marks for storage”, drawn up in accordance with Appendix 2 to the Instruction on establishing (restoring) boundaries of land plots in kind (on the ground) and fixing them with boundary marks, approved by the order of the State Committee of Ukraine on Land Resources No. 376 dated 18.05.2010 (the Instruction), “further information on established boundary marks”.\u00a0<\/p>\n<\/p>\n
The form and procedure for compiling the “information on established boundary signs” stipulated by Law No. 1423 are not specifically regulated by legislation. Such information may be displayed in an arbitrary form, identifying the location of fur signs and containing their description. According to Article 106 of the Land Code of Ukraine as amended by Law of Ukraine No. 1423, boundary signs can be natural or artificial structures and boundaries (rivers, streams, canals, forest strips, vegetation strips, trees, paths, streams, walls, fences, fences, road structures, concrete or metal pillars, slabs, monoliths, stones, other structures and boundaries) that coincide with the boundary land plot or specially installed on it. Boundary signs are not installed on water bodies. In the event that the boundaries of land plots in kind (on the terrain) coincide with natural or artificial linear structures, boundaries (rivers, streams, canals, forest strips, vegetation strips, roads, paths, rivulets, walls, road constructions, fences, fences, building facades, other linear structures, boundaries, etc.) and previously established boundaries of formed land boundaries plots, boundary marks may not be installed.\u00a0<\/p>\n<\/p>\n
The location of boundary marks in the case of their determination or installation is reflected in the materials of land management planning and geodetic surveys, as well as on cadastral plans of land plots. At the same time, the compilation of “information on established boundary marks” in the form and order specified by the Instruction does not contradict the requirements of the Law of Ukraine “On Land Management” as amended by Law of Ukraine No. 1423. It should also be noted that in accordance with the eleventh paragraph of the first part of Article 34 of the Law of Ukraine “On the State Land Cadastre”, the cadastral plan of the land plot displays information about established boundary marks (in the case of the formation of a land plot).<\/p>\n<\/p>\n
