One of the common violations of labor legislation is the hiring of an employee without an official registration of labor relations. At the same time, an entry in the work book is not a basis for automatic inclusion of this period of work activity in the insurance experience, which will be taken into account when calculating a pension, as well as when providing assistance for temporary loss of working capacity, unemployment, etc.
According to Article 1 of the Law of Ukraine “On Mandatory State Pension Insurance” No. 1058-IV dated 07/09/2003, which entered into force on 01/01/2004 p., insurance length of service is the period (term) during which a person was subject to state social insurance, for which or for which the fee for mandatory state pension insurance was paid in accordance with legislation that was in force before, and/or is subject to mandatory state pension insurance in accordance with this Law and for which insurance premiums have been paid.
Thus, only the period for which insurance premiums were paid is included in the pension. How can an employee check whether the employer pays insurance premiums and whether this period of employment will be included in the insurance period?
In the context of the adoption by the Verkhovna Rada of Ukraine on February 5 of this year as a basis, in the second reading and as a whole of the draft Law on Amendments to Certain Legislative Acts of Ukraine on Accounting of Labor Activity of an Employee in Electronic Form (reg. No. 3623 dated 10.06.2020 p.), we inform you about the following.
Today, the portal (hereinafter referred to as the Portal) of the Pension Fund of Ukraine (hereinafter referred to as the Pension Fund of Ukraine) is successfully functioning, where you can obtain information about employment, existing insurance history, the amount of contributions paid to the Pension Fund and the amount of wages, as well as apply for a pension (upon reaching the appropriate age and insurance period), and receive an extract from the Register of Insured Persons. The portal is available around the clock and is located at the link https://portal.pfu.gov.ua/.
In addition, PFU has developed a corresponding application that can be installed on a smartphone or tablet running Android and IOS, which also provides access to the Portal.
Today there are the following methods of authorization/registration on the portal:
– By electronic digital signature (EDS), which can be obtained from the state tax service or any other accredited key certification center, as well as the Privat24 service from Privatbank and some other banks;
– By login and password, which can be obtained at the PFU branch, taking with you your passport, identification code and filling out the appropriate application. After filling out the application, the citizen receives a Registration Code (application code). This code is required for registration on the Portal. That is, it must be kept secret until the end of registration. You can complete the registration at any time by visiting the Portal on the Internet;
– By identification in the ID GOV UA service, which includes identification by EDS, by mobile phone (Mobile ID) or by bank identification in one of 27 banks of Ukraine (Bank ID).
The portal provides electronic services to each person individually and works in compliance with information protection requirements.
One of the services that works on the portal is the “Electronic work book” service, which allows you to view information about work activities based on the employer’s reporting information. It also contains information on paid insurance premiums since 2000 (in some cases since 1998).
In addition, a free SMS notification service can be set up on the Portal, which will allow insured persons to receive free monthly short messages about the crediting/non-crediting of the single social contribution by the company where he works, information about “earned” personal insurance experience. The data will be sent in the form of an SMS to a mobile phone and/or in the form of an e-mail to an e-mail. You can also connect this service at the PFU branch.
If there is no access to the Internet, the employee can also apply for an extract from the Register of Insured Persons to the PFU branch, taking his passport and identification code with him.
