On February 2, the Verkhovna Rada of Ukraine supported in the second reading the Draft Law on Amendments to Certain Legislative Acts of Ukraine (Regarding the Unified Legal Status of a Land Plot and Real Estate Located on It) No. 0850.
The draft law will regulate the problematic issue of the transfer of the right of use to a land plot in the event of the acquisition of a real estate object located on it.
Amended the second part of Article 120 of the Land Code of Ukraine (Vedomosti Verkhovna Rada of Ukraine, 2002, No. 3-4, Article 27):
If a residential building (except an apartment building), a building or a structure is located on a land plot that is in use, then in the event of acquiring ownership of these objects, the right to use the land plot on which they are located is transferred to the acquirer, under the same conditions and to the same extent as the previous land user.
If a residential building, building or structure is located on a land plot that is in permanent use, and the acquirer cannot use the land plot with such a right, the land plot passes to the acquirer with another real property right”.
After the entry into force of the law, in case of acquisition of a real estate object located on a leased plot of land (in particular, in a rural area), there is no need to conclude a new lease agreement and make changes to it as well.
